Article 1 — Seller Identity

These Terms of Sale govern all purchases made on www.drinkfinote.com between Native Drinks SAS and any adult individual placing an order (hereafter "the Customer").

Article 2 — Products & Pricing

The products offered for sale are certified organic non-alcoholic botanical aperitifs sold under the FINOTE brand.

All prices are displayed in euros, inclusive of all applicable taxes. The VAT rate applied is 5.5%, in accordance with the classification of non-alcoholic beverages under French law. Customs duties and VAT are included in all prices displayed for deliveries within the European Union.

Native Drinks SAS reserves the right to modify prices at any time. Products are invoiced at the price in effect at the time the order is confirmed.

Article 3 — Order Process

Orders are placed through the following steps:

  • The Customer selects products and adds them to their cart.
  • The Customer enters their delivery details and selects a payment method.
  • The Customer confirms their order and completes payment.
  • An order confirmation email is sent to the Customer, summarising the products ordered, the total amount, and the delivery address.

The sale is deemed concluded upon receipt of the order confirmation email. Native Drinks SAS reserves the right to refuse any order in the event of an existing dispute, non-payment, or suspected fraud.

Article 4 — Payment

Payment is due in full at the time of ordering. Accepted payment methods are those available during the checkout process on the website, secured by current encryption protocols.

No banking data is stored by Native Drinks SAS. All payments are processed by a secure third-party payment provider.

Article 5 — Shipping

We ship to all EU countries. Estimated delivery times for orders placed before 11 AM are as follows:

  • France: 1–2 business days
  • Rest of EU: 4–6 business days

These are estimates and may vary due to external factors such as carrier delays, customs processing, or high demand periods.

Due to our rapid fulfillment process, orders are transmitted to our logistics center immediately upon payment confirmation and cannot be modified or cancelled once placed. We encourage Customers to review their order carefully before completing their purchase.

If an error is noticed after validation, please contact us as soon as possible at contact@drinkfinote.com. We will do our best to assist depending on the status of the shipment, but cannot guarantee intervention.

If an order has not been received within five weeks of the shipping confirmation, the Customer must notify us at contact@drinkfinote.com. After five weeks without notification, the order will be considered delivered.

Article 6 — Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code and Article 16(d) of EU Directive 2011/83/EU, the right of withdrawal does not apply to goods liable to deteriorate or expire rapidly, or to goods that have been unsealed after delivery and cannot be returned for hygiene or health protection reasons.

As consumable beverages, FINOTE products are expressly excluded from the 14-day right of withdrawal. All sales are therefore final upon dispatch.

Article 7 — Returns & Refunds

Damaged or defective products

If your order arrives damaged or defective, please contact us within 7 days of receipt at contact@drinkfinote.com, including a photo of the damaged product and your order number. We will assess the situation and, where applicable, offer a replacement or store credit. We reserve the right to request the return of damaged goods before issuing any remedy.

Incorrect orders

If you received an item different from what you ordered, please notify us within 7 days of delivery at contact@drinkfinote.com with your order number and a photo of the item received. We will arrange for the correct product to be sent to you at no additional cost.

Refunds

Refunds are only issued where a replacement cannot be provided (e.g. product out of stock following a confirmed damaged delivery). Refunds will be processed to the original payment method within 5–10 business days of our confirmation.

Article 8 — Allergens & Food Safety

FINOTE products contain none of the allergens listed under EU Regulation (EC) No 1169/2011, including: cereals containing gluten, crustaceans, eggs, fish, peanuts, soybeans, milk, tree nuts, celery, mustard, sesame seeds, sulphur dioxide and sulphites, lupin, and molluscs.

Although our products are manufactured in compliance with applicable food safety standards, they are produced in a facility that handles other plants and botanicals. Customers with specific sensitivities are encouraged to review the full ingredient list on the product label before consumption.

Article 9 — Liability

Native Drinks SAS is committed to delivering products that conform to the order placed. Our liability cannot be engaged in cases of:

  • Delay or loss attributable to the carrier after handover of the parcel
  • Misuse or improper storage of the product by the Customer
  • Force majeure events (natural disaster, strike, pandemic, etc.)

In the event of a lost or significantly delayed parcel, we will endeavour to assist the Customer in their dealings with the carrier, without any commitment to automatic replacement or refund.

Article 10 — Personal Data

Personal data collected during the ordering process is handled in accordance with the General Data Protection Regulation (GDPR — EU 2016/679) and applicable French data protection law. It is used solely for the purpose of processing and tracking orders.

Article 11 — Governing Law & Disputes

These Terms of Sale are governed by French law. In the event of a dispute, an amicable resolution will be sought as a priority. The Customer may also refer the matter to a consumer mediator, in accordance with Articles L616-1 and R616-1 of the French Consumer Code.

Failing an amicable resolution, the competent court shall be the Tribunal de commerce de Perpignan, France.

Article 12 — Amendments

Native Drinks SAS reserves the right to modify these Terms of Sale at any time. Changes take effect upon publication on the website. Customers are encouraged to review them regularly.
